Today was published the “Regulation for the Granting of the benefit of the fund for the protection of employment” of the Ministry of Economy, through the Governmental Agreement 58-2020 that has to establish the conditions and requirements to access the economic benefit that the State will grant to the workers of the private sector in case their work contract has been suspended.
The benefit of the fund for the protection of employment will grant to the workers of the private sector that count with the suspension of the work contract duly authorized by the Ministry of Labor and Social Welfare, a fixed amount of seventy five Quetzals (Q. 75.00) daily to the worker exempt of any type of tax reduction, which will be delivered through bank transfers or any other available means by the National Mortgage Credit of Guatemala. In addition, this benefit will only be granted to workers in the private sector whose employers are not in the cases of exception established in the presidential provisions derived from the state of public calamity.
In order to obtain the benefit in question, the employer must enter the digital platform of the Ministry of Economy (www.mineco.gob.gt) where he must attach the authorizations of the employment contract suspensions of the Ministry of Labor and other documents required for the purpose the Ministry of Economy may admit the application for processing. Subsequently, the authorization will be issued for the proceeding to the payment of the economic benefit as long as the employer complies with the corresponding requirements and with this, the authorization will be sent to the National Mortgage Credit of Guatemala to carry out the accreditation by means of a bank deposit or any other means or instrument available.
The benefit of the fund for the protection of employment will only be available during the present fiscal year as of the assignment of the funds on behalf of the Ministerio de Finanzas Públicas [Roughly equivalent to the Department of the Treasury.
