El Salvador is undergoing a process of modernization of its public institutions, in which the Supreme Court of Justice is playing a leading role in spearheading the transition to a hybrid notarial ecosystem as part of its digital transformation. This process incorporates the certified electronic signature of notaries and new online services. Although the reforms to the Notary Law are aimed at the exercise of notarial functions, their practical effects extend to a reality that demands verifiability, traceability, and agility in legal acts.
Last week, with the launch of new online services for the Single Electronic File for Lawyers and Notaries, a major step forward in national digitization, the Supreme Court of Justice marked a milestone in institutional innovation. With around 17,000 active notaries immersed in this transition, the country is moving toward a more standardized, traceable, and technologically robust model.
This momentum is in line with other recent legislative reforms that aim to create interoperable, better-structured, and technically more agile institutions. Among these are provisions on solid waste, intellectual property, registration of natural persons, land use and construction, prevention of money laundering and terrorist financing, protection of personal data, and the energy sector. Together, these initiatives seek to position El Salvador as a more efficient and reliable legal environment for doing business.
The so-called “Digital Protocol,” while not eliminating the physical book, introduces changes that increase operational efficiency and legal certainty in relations between private parties. For these actors, digitization facilitates compliance checks and reviews, reducing time. The submission of the protocol in digital format also enables faster and more orderly access to historical notarial information.
The uploading of documents and information through the platform, within the established deadlines, reduces the risk of loss, duplication, or inconsistencies. High-value monetary records, suspicious transactions, and sensitive instruments must be submitted electronically within short deadlines, which strengthens internal control and reduces contingencies due to non-compliance.
For companies or financial groups subject to anti-money laundering provisions, this development represents a significant advance in auditing, supervision, and prevention. Strengthened controls and information traceability facilitate regulatory compliance and early risk detection.
As discussed above, the transformation of notarial services is part of a broader ecosystem of government initiatives aimed at digitizing and modernizing public administration. This enhances institutional interoperability, optimizes procedures, and promotes the cross-cutting use of electronic signatures. For companies—whether domestic or foreign—this translates into greater predictability, standardization, verifiable processes, and a more modern regulatory environment, especially in transactions and operations that require notarization by a Salvadoran notary public.
This new framework requires technical and legal adaptation on the part of notarial teams, corporate legal departments, public institutions, and, in general, those who use these services. The effective execution of each public instrument, coupled with the duty of timely electronic submission, entails strengthening compliance with legal and technical guidelines, systematizing internal processes, and ensuring the validity and effectiveness of legal acts, which will require specialized professional support.
The digitization of the notarial function marks a significant step in the effort to modernize the State. Its implications will continue to unfold in the coming months. As the system evolves and its tools are consolidated, companies will need to adapt to take advantage of its benefits and anticipate potential risks. The hybrid environment will pose challenges, but it will also open opportunities for more agile, traceable, and secure processes. Our team remains attentive to the transition and available to accompany our clients at every stage.
