Guatemala recently took an important step in the protection of Intellectual Property with the inauguration of the Copyright and Related Rights Mediation Center. This initiative, promoted by the Intellectual Property Registry in collaboration with government institutions and international organizations, seeks to offer an agile and effective mechanism for the resolution of conflicts related to copyright, promoting justice and the protection of creators.
I- Objectives
- To provide a neutral space for the resolution of disputes in the field of copyright.
- To promote dialogue and conciliation between authors, artists, publishers and other actors involved.
- To decongest the judicial system through an efficient and less costly alternative to traditional legal processes.
- To promote respect for intellectual property and strengthen the culture of legality in the creative sphere.
II- How does it work?
The center offers mediation services, allowing the parties in conflict to reach agreements with the assistance of mediators specializing in Intellectual Property. This process is voluntary, confidential and seeks practical solutions that benefit all parties involved.
Among other advantages, the center has the backing and collaboration of the Arbitration and Mediation Center of the World Intellectual Property Organization (WIPO) and allows the use of its platform designed specifically for this purpose, allowing the user to access the service through an online form, and to carry out the procedure entirely virtually, through an online hearing, or in person at the Center at the RPI headquarters, if preferred.
III- Importance for Guatemala
Guatemala is a country with a rich cultural and creative diversity, but historically it has faced challenges in the protection of copyright. The opening of this center represents a significant step forward for:
- Artists and creators, who will be able to defend their works in an accessible and effective way.
- Cultural industries, which will have a more solid legal framework to operate with greater legal certainty.
- Society in general, by fostering a culture of respect for creativity and innovation.
