Mutual agreement as a cause for labor termination in Honduras

In Honduras, as in other countries in the region, labor legislation contemplates and regulates mutual agreement as a cause for termination of employment.

This type of agreement implies that both parties involved, i.e., employer and employee, jointly agree to terminate the employment relationship that binds them. Terminating a relationship by mutual agreement guarantees the employer the release from labor liability, avoiding the possibility of a subsequent lawsuit, if the agreement is properly executed and documented as a settlement.

In addition, the mutual agreement allows the establishment of favorable payment terms for both parties, in which lower amounts can be negotiated while still fully recognizing the non-negotiable benefits required by law. In Honduras, these benefits include the thirteenth month, fourteenth month, vacation and salary. However, alternative terms for notice and severance payments may be agreed upon, such as lower percentages or installment payments. In some cases, additional benefits may be offered as an incentive to facilitate the agreement, always in accordance with the capabilities and needs of the parties involved.

This type of agreement also makes it possible to organize exit dates, which facilitate planning within the company to reassign functions or prepare for an orderly transition. For the employee, mutual agreement can provide time to look for new job opportunities, as well as help maintain good references without affecting his or her work history. In addition, the mutual agreement termination document may include a confidentiality clause, protecting both the information agreed upon and the knowledge acquired by the employee during the performance of his or her services.

Among the possible disadvantages of the mutual agreement is the employee’s refusal to sign it, since, upon termination of the employment relationship, he/she would lose access to social security. Therefore, it is important to consider the employee’s health condition, especially if he/she is under treatment under Social Security. In cases where the termination of employment is urgent, an extra benefit may be agreed as compensation.

It is recommended that the mutual agreement be made with respect to the protection of the employer’s information and the employee’s rights, preserving both the company’s image and the employees’ conditions to avoid generating uncertainty in the work environment.

The labor legislation in Honduras allows the termination of an employment relationship by mutual agreement without the intervention of the labor authority, provided that it is carried out in accordance with the law and recognizing 100% of the rights and indemnities established in favor of the employee.

In conclusion, to ensure the effectiveness of a mutual agreement, it must be applied in accordance with the legal parameters, recognizing all the rights applicable to the employee and seeking an agreement that benefits both parties.
